Legal advice about hospital

So the other day I have a seizure. I wake up in the ambulance confused as fuck. In the hospital for a few hours and I can’t really walk or move very well because I’m disoriented and very sore from the convulsing or whatever. They move my bed into the hallway because they need the room and then discharge me shortly after. I’m limping and can hardly walk and I’m alone. I limo from my bed throughout the emergency department and out the main door to the parking lot. I see my girls car and I waddle towards it, right as I get next to her car there is a curb and when I step down my knees give out and I fall face first onto the pavement, my hands don’t go out and save me for whatever reason and I land on my fucking nose and splatter it. Blood is dumping everywhere and it’s cold and wet everywhere. My girl jumps out and helps me into the car. It’s been a few days now and my nose is much smaller but there’s a big gash on the tip and looks like it’ll probably scar that way.

My girl says I should sue the hospital for just kicking me out of the bed and not wheeling me out or even walking me out, when I was clearly a fall risk and DID fall and now could have a fucked up face forever. BUT I didn’t feel like going back into the hospital when it happened, it was like 5am and I had been there since like 10pm and I was soaked and cold and bleeding and in pain and just wanted to go home.

What do you guys think? If I tell the hospital that I’m thinking about suing will they like “lose” the footage if there is any still, or should I go to the hospital asap and tell them so they can save the footage before it’s filmed over. Should I just contact a lawyer first. Should I report the incident to the hospital first, should I report it just to have it on file, but not sue. Can you only sue if there’s like mega damage, or does smashing my face and bleeding all over my girls white Kate spade coat count as enough damage? What do you guys think?

I work in a nursing home which is just as similar in shadiness. They will get staff to say they offered you assistance to your car but you had opted to go on your own. All staff present will fill out witness incident statements and they will all favor the hospital. Yes they may have you falling on camera but the extend of injury to the face will be questionable since you didnt go right back in after it happened. "You could have fell again at home". You will need to miss work and incur more bills to make it a worth it case for a lawyer to seek reimbursement and pain and suffering. If claiming PTSD you will need to spend out if pocket first on therapy then present that to the court. Hate to be a debby downer but not going right back in so they can treat your nose and have the extent of damages on record may make it harder for a lawyer to want your case. Unless you have a friend lawyer that wont want about $5,000 to help you sue for $7500 and missing work for hearings and tons of paperwork. Remember they have top lawyers protecting them even though it could just be an insurance payout for them they will fight you because your lawsuit will be public record and stain on their reviews. But hope you are feeling better my man and you are in my prayers for COMPLETE healing for whatever caused the seizure

Thanks a lot man, this is all great info, and honestly I’m not really expecting much, the only reason I’m even considering trying it is because the gash on my nose looks like its scaring and I’ve heard people say you can get paid pretty good for facial scaring.

Definitely worth a try. A settlement might be in their best interest just to make it go away then you walk away with some more cash for some AAS

Ya like a little 20k or something? That would be nice. If they offer anything I’d probably just take it, cus I’d be pissed at my self if they offered me like 50k and I turn it down and then I end up losing the lawsuit or I win and only get like 10k I’d be pissed off that I passed it up.

Go to a lawyer. If he thinks you will win, he'll take your case without retainer and get paid when you settle. He will set the price and try for as much as he can get. You might only see 40 to 60 percent of it. So he'll go big and you might see a good bit of money. win win.

If you are asked to pay anything up front, look for a different lawyer.

YA RIGHT!! I wish but I won’t get much if anything. The only reason I would get anything is because I have facial scaring. But I don’t have like medical bills or lost work or anything like that so If anything id probably only get like a couple grand or something

Plus there’s some wealthy dudes on here for sure, idk about 8 figure, but I’ll let y’all know if I hit it big!

Shit hurts pretty good, I think it might be broken but maybe not since it’s not like smashed to the side it doesn’t look all crooked. You think I’d know for sure if it was broken? It just feels like hella sore/bruised, but the swelling came way down, in this picture it’s at least double the size it is normally,

I've had them walk me to the car, or wheelchair me to the car. I've also had them release me on my own or to the wife.

Last 5 years: 5 cardioversions (jumpstarts), 2 ablations (scar inside of heart) and a ruptured appendix with its own abscess.

Old age, it's a trip,........................and a fall.

Ya and I’m lucky. My gf had a HORRIBLE experience at a hospital a few years ago. She would be screaming in pain, anytime someone went to touch her. And they said she was faking it and trying to get stronger pain meds. She did want stronger pain meds because she was clearly still in pain and screaming.
Because of their negligence she developed a horrible pressure wound/bed sore. That went all the way down to her spine. And was discharged with it. I was cleaning her up at home, giving her sponge baths because she couldn’t move and I rolled her over to get her back and saw the most horrible black wound I’ve ever seen. And it smelled horrific. I was cleaning her because the room stunk but I thought it was because she had gone to the bathroom on herself because she couldn’t move or do anything by herself. The smell was infection and rotting flesh, immediately she was rushed to a different hospital and was admitted, she was going septic and would’ve died if she kept laying on the couch at home. That first hospital basically would’ve killed her, if I hadn’t found that wound. And they were super rude to her and calling her a liar, just a horrible experience. So I’m kinda lucky, I was atleast treated nice and taken care of, just needed a wheelchair to the car that’s all lol

Make sure tou get as much documentation as possible and call a lawyer and explain what's up. Sorry you're going through this. I never like to sue anybody but this is a hospital and it sounds like you're well being was not a priority while in their care. I'm not lawyer but I bet you have a case.

I had a grapefruit sized lump abcess from using a dirty needle in my glute. After trying home surgery, I gave in and went to the hospital. The first er visit they landed it, maybe 10/20ml of puss came out. Bandaged me up, said if it gets worse come back. Three days later, it's worse, I got back to the er, the doc who checks me out says go home and take a hot bath, but got compression on it. If id have walked out and went to another hospital, I'd have been able to sue the pants off t he hospital. Turns out I was septic, who angels of doctors, beautiful nice women where like "this guy needs to be admitted right away" i could see the fear they were showing. They landed it again and I think 150- 200mls of infected puss came out.

Don't mean to highjack you thread, I'm great at making everything about me, working on it... my point it... I regret not at least researching if I had a case. And it's not ppl that you're suing directly. It's the insurance companies and hospitals so fuck em. They deserve it. Imho

Ive gotten seizures from Xanax withdrawals. Twice. Cracked my head on the pavement in front of the xs family on mother's day. Also seized out driving, went into incoming trafficking. Thank the angels in my back I didn't hurt anyone. Only broke my shoulder. Yeah sue the pants off them. Sounds like you have a case but... that hospital has the best lawyers. Hospitals like that... they must keep back ups for footage, I would hope. Crime In itself if they try to erase the footage. Good luck man. Hope it all works out.

Ya if suing was going after an individual I wouldn’t even consider it, but whatever I sue them for is probably less then they made off that single ER visit. I have way more damage from that fall than I do from the seizure itself. If I wasn’t 30 years old that shit could’ve killed me, so many elderly people die from falls, they go into a hospital and never come out, they just kinda fade away.

I fall HARD, landed square on my nose, I was too weak and uncoordinated to put my hands out and for some reason didn’t break my nose. I’m just worried I didn’t document enough. I should’ve had my girl take pictures of me bleeding everywhere and then the size of my nose the next day and everything. I have my hospital bracelet covered in blood and my Covid mask soaked in blood and my girls coat from her trying to stand me up. But maybe atleast starting the process will remind that hospital ER to not release people in that condition and will instate a rule where everyone must be walked to the door or to a vehicle or something. I think it is a rule already but seems like it isn’t enforced like it should be.

I’m SOOO lucky the seizure happened when it did. My kids went to spend the night at their grandparents house at like 5pm, my girl got home from work at about 10:15 pm, I had the seizure at about 10:20pm. Just moments after she walked in the door, I would’ve been home alone if it happened any early or with my kids alone if it happened earlier in the day. I had no symptoms of “detoxing” from the xanex and never thought it was even possible to have a seizure after that small amount of usage. I was a little concerned about having more severe anxiety once I stopped talking them, since that was why I started but I specifically didn’t want to develop a habit which is why I stopped. Just must’ve been the perfect storm I guess, but I appreciate the love man, thanks

Sorry I don’t have much advice but it seems shady to just be left to your own devices when in such critical shape. You shouldn’t be discharged in that condition. I would talk to a lawyer.

I am pretty sure that if u didn't follow up with hospital visit right after is a lost cause. I know someone in the process of suing and it's all about paper trail and proof in black and white. For pain and suffering. Follow up rehab visits u name it. They need more than you saying I'm fucked up. They want a professionals opinion. Lawyers have doctors that will sway things your way. U should call a lawyer asap cuz it might not be too late but probably is. They might be able to send you to one of their doctors though. And they will get the security footage don't even call the hospital yourself. The lawyers get paid to do that.
That hospital was Def in the wrong though. But u did sign papers when u left and that might wave their liability also.
Do hope u feel better tho. Wasn't due to the juice i hope?!

Ya me signing the discharge only absolves them from normal occurrences, like to do with whatever work they did. But I was delirious when I signed it anyway so it really wouldn’t matter either way. But you’re right, lawyers get paid to find that footage and everything, I’ll let them do it if necessary. And yes I’m getting better, thank you! And no, no juice involved fortunately!!

I would definitely contact a lawyer first to see what he has to say. They have their ways of getting shit done if they take your case. I'm not sure where you're from but in the U.S. not sure if it's all states but mine you have up to 2 years to file a medical malpractice lawsuit. I would call one and go from there. Usually do free consultations. I think there would be a lawsuit especially if a doctor didn't sign off on your release and you get that video. Good luck bro.
Also hope you know or found out the reason for the seizure because that's pretty serious to seize out and not wake up till the hospital.

Ya that’s what I thought but I wasn’t sure, because they’d be in more trouble if they were caught fleeting footage and shit, so I wasn’t sure if they just hand it over as policy or if shit would get shady. But I kinda figured if I told them, then something would “mysteriously” go wrong with the equipment or something

Really sorry to hear about this Buddy - is this the first time you have had a seizure or has it happened before? Do you know why it has happened? I am sure you have a case here, I cannot imagine they would try get rid of the footage but you wanna make sure at the same time they don't as that is the only evidence you have of it happening - I think I would speak to a proper Lawyer first and see what the best plan of attack is. I am pretty sure Davos on here is involved in Law.

Thanks man, So the theory is that I was kinda dabbling with xanex the month before. And I hadn’t taken one ina few days, so I guess I’m just super super low seizure threshold and had one from “detoxing” off benzos even tho I only dabbled with them and wasn’t taking them daily or in large amounts. They said I also tested positive for the flu which probably also lowered my threshold. I took about 20 one mg xanex over the course of like 5 weeks which I didn’t think was even close to enough to need to detox off of but idk. I didn’t have any symptoms either just randomly had a seizure.

But ya I wasn’t sure if the hospital woukd try and hide the footage or if that’s like super illegal so they wouldn’t even attempt it or what. And idk if it’s even worth doing, or what.

2 years ago yesterday was my good friends death. One of the smartest, nicely ppl ive ever met. Some unresolved pain/trauma that he had be sel medicating with benzos for 15+ years. With alcohol. He froze to death on the street in Brooklyn bc He had a seizure. Couldn't get meds that would have saved his life. Alot of countries you can buy Valium otc for 50 cents. A frigging Valium would have saved his life.

Sorry I wanted to add that. The system is so fucked. People who are unqualified run shit. The world us run by dumbasses. It's caught up to us.

The crazy thing dor me about Xanax seizures... they happen on day four of me getting off them. The first time, I wasnt prepared for it. I figured, it's been four days. I'm probably out of the woods. However, twice ive had seizures from Xanax withdrawal. It's terrifying bc I don't know when its gonna happen. I got just faceplate onto subway tracks and not wake up. Yeah I barely had any symptoms. Things seemed off but I didn't get the sense that I was withdrawing. Seizure are no joke

That’s good to know, the hospital gave me ten Ativan to taper with. I probably shouldn’t have even started taking them because I think I was probably in the clear after the seizure, but I wasn’t sure. So once I taper off I’ll keep an eye out on the 3rd-5th day.

One of the withdrawal symptoms for alcohol and Xanax is seizure or fainting. It is much more severe for alcohol. There’s a name for it. It only takes 5 to 7 days to develop a dependency. Although 20 doses of 1mg Xan over 5 weeks wouldn’t constitute a seizure, it is possible the lack of benzo could magnify another issue causing a seizure. Can’t rule it out because those drugs are weird like that. I’ve seen it many times and it’s not fun to witness.

As for the nose, you would have had to go right back into the hospital after that and do paperwork and go right back into treatment. You can still pursue legal action, might need to get an attorney first because they might not help you easily if you come snooping around for footage and other stuff.
