Okay brothers, just when you think your on top of your shit and you got your money situation all dialed in, life comes in with some left and right hooks, a fat power double and some ground and pound and just fucks your shit up...
Okay this is what happend i know theres a lot of smart mother fuckers on here so what would you do in this situation, heres what happend..
Okay i'm going to the gym, so i stop in at del taco to fill up on some diet pepsi to make that HYPHY MUD son,- yeah im a cheap penny pinchen mofo- so i get that handled downed it.. now im gettin ready to back out and check all 3 mirrors with a reach around -no homo- and im backin up and booom!! and i hear this guy honking,, and im ready to fucking kill shit!! pre-workout kickin in- my face all scratchy and shit.. so i jump out of the car to find its this older nerdy looking dude, he looks like he just took a shit and is trying to hide the fact he did.., and im in my tank, veins poppin, ready to fuckin go to war, and you gotta imagine i ddint look very friendly.. i knock on his window and start questioning him cmon bro wtf happend were you not paying attention, trying to be civil about it.. Taking heavy deep breathes he gets out and starts asking for my information and so were exchanging info and this fat hodgey podgey lookin bitch comes waddling over, huffin and puffin, im like okay someone who seen and coming to let me know it wasnt my fault.. Nah.. she walks straight to this guy and starts babbling " i seen the whole thing, he had his head phones in and you honked, heres my number if you need a witness".............................. Bros, it took everything i had inside me not to start yelling at this bitch to mind her own fucking god dam business and go back to the fucking zoo where you came from heres the number jenny craigs and on and on and on......

Who is at fault here me or him? i obviously checked all the mirrors and looked around and he mustve been coming out like a bat outta hell... but i still dont know whos at fault brothers, if you were an insurance company who would be at fault here.. obviously he has a witness so im guessing im kinda screwed unless i pretend like i never seen this lady before, and im not willing to risk lying, for some stupid shit with all the cameras who knows... the goverment is probably watching me right now..
I already called the dude and told him to get a quote and that ill pay him in cash for the damages, hes being pretty civil about it.. to buy me some time to figure out what i should do.. What would jesus do in this situation? or you? should i suck it up and fork over how ever much its gonna be? this is really irritating

Insurance companies have worked out a formula years ago on which company pays what based on the point of contact.
Fault or blame has nothing to do with it.
It's a bean counter approach -cheaper than attorneys. In this case each party may pay their own damage. I.e. a "no fault" accident.
Ask your insurance company how this will affect your policy and go from there. You do not need to make a claim, figuring you have a deductible, you might just want to pay out of pocket.

File a police report and file your claim against him. It's a parking lot accident, so whomever gets the most aggressive with providing documentation will win.

IF he has a witness stating that she observed the accident and observed you WITH YOUR EARPHONES on/in, you're pretty f-ked IF this goes to your insurance company, Mate.
Insurance companies LOVEEEEE independent witnesses, who'll happily stand up in a court of law, (So they can get their freak on and/or feel more important than they really are. Even if they are built like a Mickey D's burger), just to save them from paying out for your own, "Driving Without Due Care And Attention", issues.
That MAY not be the case of what had happened. But it is what happened if it goes to making a claim for damages because there are witnesses saying it did. Just hope this guy doesn't suddenly start feeling like he has whip-lash, etc, just to get a bigger payday from your insurance company. THEN your premiums WILL go up.

So you were parked and backed into someone that was driving through the parking lot? I would guess that you would be held responsible, however I didn't see any mention of a police report. Most states and insurance companies require a police report to process any sort of claim.
I rear ended someone in Texas years ago. I was driving a Honda Civic and the guy I hit was in a Chevy 2500. No damage to his truck....totally destroyed my boys bumper. Long story short, we didn't file a police report and I had offered to pay to have a small dent and scratch in his bumper fixed. But we also exchanged insurance information. Weeks later he calls me and says that its going to cost him $6500 to get his bumper fixed. This was for a fucking quarter sized dent and scratch! I told him to fuck off so he calls his insurance company who then calls mine. Geico calls me and says that he wants $6500 for his bumper and is now trying to sue for medical costs because his back got hurt. Civic --> Chevy 2500....again yeah fucking right. Anyway, point of the story is that because there was no report filed, neither myself or my insurance company had to pay shit.

I think a lot of it boils down to state laws. Plus, depending on what the parking lot looked like (curved, etc) ...if he was speeding it could be his fault.
If he shoots you straight with the cost to fix it, I would pay up. If he tries to pull something, like the guy I hit, tell him to fuck off.
Best thing for you is that this happened in a parking lot, which is private property. Cops have no jurisdiction to cite traffic violations there, because traffic laws do no exist outside of the roadway. Insurance companies will not cover another vehicle, regardless of fault, when the wreck happens on private property because fault is assigned by who violated the traffic law.
So, this is a nice way of telling the guy to duck off. Feel free to call and ask your insurance company. They'll tell you the same thing. Something I learned the hard way...

In many states that is illegal to have, I only know from checking the laws about wearing them on my Harley. Also usually it is the person in motion who is responsible if the other party is stopped but again this could vary.
