Conflict of interest criminal law
Hello guys
Any input would be appreciated
On the 7th or april 2018 i was remanded into custody
I was appointed a lawyer through legal aid for my first bail application which was on the 3rd of may 2018
I got knocked back ,bail got knocked back another 2 times before i got bail.on the 10th of october i got bail.
On the 2 july 2019 i had a final directions hearing which got adjoured untill the 16th july 2019.
Ok so the lawyer the represented me on my first bail application is now on the prosecutors side he was at court on the 2 july and 16th july working against me and im pretty sure he was the prosecutor on other occasion i was at court like altering bail conditions.
"all for the same case"
My trial starts on 2 september 2019
It got brought to my attention by the law firm im dealing with
So thats a conflict of interest unless im mistaken
If it is what happens know
I have an appointment 2morrow with the firm
But just to get an idea
Any help would be great

If what your saying is that your criminal defence lawyer that repd you in the beginning is now a police prosecuter then yes you should go for aquital/ mis trial.
Definatly a conflict of interest that the magistrate judge needs to made aware of so he or she can proceed in that favor.
The crime does not matter if that is 100 percent the truth.
Ive seen murder aquitals for less.
You have 3 years in which to get any convictions over turned and infact claim compensation against the director of public prosecution.
In future dont break the law or atleast dont get caught.
Your not a gangster if you get caught, it means your shit at what you do so get a new job.
If you cant be a crim without being caught you suck.
Beleive me i was an underworld enforcer for 11 years, been there done that.

So legal aid is goverment funded lawyers
The firm im with is david barrese and associates
So when i first got remanded into custody 7th april 2018 a lawyer at the firm got me this barrister for my bail application, which got denied thats my only altercation with him.but we still discussed the charges and went into detail ,so defiantly a conflict of intrest.
But the layer from the firm that has been handling my case has now left the firm.
So the head of the firm/david is gonna be directing a barrister.
i spoke to the head of the firm he told me theyve taken him off the case so his no longer the prosecutor
So thats good
My trial is on september 2 this year scheduled for a five day trial
Ive been on bail since october 10th 2018
10k assurity
Gotta sign on every day
Got a curfew cant leave till 6am gotta be home by 9 pm
Cops can come randomly to check if im home
And i cant go into a perimeter
I had a clean criminal record
All my charges happened with in a month
I took a break from bodybuilding life style for a couple of month because i was doing it for so long and kinda was over it.so i was more on the streets
First i got charged with 5 counts of assaulting police and 5 counts resisting arrest
I got bail
5 days later they got me with cocaine trafficking and possession of a weapon
Police harrasment "five days later"chances of that
I got bail again
So i was on two counts bail
Then about three weeks later attempted aggravated burglary
Which i didnt do all they got on me is the victims saying it was me, thats it
But because its a serious offence and i was on two counts bail it made it so hard to get bail
The first two charges have been dealt with and dropped.
Its just the last one now so fingers crossed
Feeling confident but still you dont know.
Havnt missed a day of signing on
Havnt reoffended since been on bail
Stick to the gym guys trust me it keeps yous out of trouble.
jayiskgood thing you are not in the U.S. cause unless you have money for a great lawyer you would be facing a decent amount of prison time. They love locking people up here. It is a big money making business.
US incarcerates the most people anywhere in the world and the population is only around 330 million people.
it is really disgusting the whole legal/prison system.

I just got convicted for firearm and knuckle dusters on lisenced premises and i got a fine and suspended sentence, jail are full so you should be ok.
Get your arse to your dr, a psychiatrist a psycologist and an anger management course, you need to show that your makng efforts to rehabilitate yourself and that your remorseful plus mentally ill.
I was in court last week and the printer ran out of ink whilst getting a print out of my record since age 18.
Ive been in 4 times but now i just go sleep at the local mental institution voluntarily for a week or 2 before the case/ trial.
A jury means your either district court or supreme.
Jury will be easy if you follow my instructions, it only takes one dude that has depression or something like that to feel sorry for you or understand mental health.
Legal aid sucks, the lawyers are paid by govt and you just pay a $30 contribution every 3 or so months and its usually capped at $2500 per case which is fuckall.
If you cant get a decent lawyer your already worse off.
Ive been convicted of intimidating witnesses and preventing them from giving evidence aswell as extorsion, aggravated assault case grevious bodily harm, firearms, weapons, deception, attempt murder and aggravated riot and affray, there just the major indictables.
Never ever plead guilty unless its a deal that keeps you out of jail and it must be in writing signed by yourself, prosecution, your lawyer and of course the judge.
Ps ive rubbed shoulders with mick gatto in melbourne and ibriham in sydney.
I was a stand over man/ enforcer for bike clubs and crime families aswell as middle eastern street gangs.
Im out of all that life now but i have the scars both physically and mentally, also i have tattoos from the top of my head to my toes, only part clean is my face.
If you go to jail fuck the rules and politics, dont ever show weakness or back down, the gangs and clubs dont matter inside they are just other bare bums in the shower, stomp anyone at any time with no hesitation and i mean that, with the exception od south australia and darwin all the prisons have segragated all 1 percent bikers into solitary units and arent allowed in general population, try not to upset the aboriginies because they run all jails australia wide and there is 5 times the amount of them inside compared to us white boys.
Ps if you are a member of an outlawed motorcycle gang you will be doing mandatory 20 yrs if convicted and if you werent born here you will be deported the say you are released.

It was part of the asaulting police deal and ill use it for the upcoming case.
Im on seriqual and valium
My doctor knows about my depression anxiety for years so ill get him to make me a medical report
Im a carrer for my 60 year old mum
The barrister told me "if i where you i wouldnt plead guilty " so fingers crossed
I know how it is in there , from the map i went to raven hall got sloted the first day had a fight with a screw was in the slot for 3 weeks then they moved me to mrc had another fight with a screw went back to the slot for another 3 weeks.then they put me in a different yard "a yard" at mrc.had a fight with a inmate got slotted again for 2 weeks then the moved me to port phillip prison.liked port phillip the most but there where bashings stabbing almost on a daily
I noticed that about the aboriginals they get well looked after
Might get urine drug test done as well to show im not on drugs
Do they test for steroids in urine or just rec drugs

Id get off the serequel and valium if i were you and switch to just staraight zoloft at max dose, you will see better results! All mental health issues arise from depression- you get low and all the symptoms appear.
Stop the low and the rest dissapear.
Ive been on all of them- serequel, zyprexa, zoloft, periphal, valium the list goes on.
Zoloft on its own at a high dose is the best thing i ever done seriously.
Serequel is combination drug, you should never take a drug to treat something you dont have- example zyprexa i was on for years- its for bi polar which i font have but it reduces paranoia and panick attacks- its like treating cancer with panadol just wont work and the sides make you worse.
Lol i stomped one of the snow town barrell boys when i was 27 living south, jumped of the sink on to his head over and over- was good except tax payers fronted the bill for his cranial facial surgery and 50k for his brand new set of veneers, cunt had better teeth than anyone afterwards.
They dont test for steroids mate its extasy/ heroin/ cocaine/ meth and opiates/ benzos and phsych meds aswell.

As much as carl was a fatboy that never did his own dirty work i didnt want him to get killed in jail, would if been interesting to see how his life turned out.
The aboriginies will make prison life absolute living hell if you upset them, they will bash everyday, day in day out, they dont stab or rape but they will make time extremly hard and intimidating.

Ok...not too sure about the US legal system but a conflict of interest is where there are competing personal obligations or interests - that is - where there is some personal gain for the individual by way of their position. Just because the lawyer who was your defence lawyer is now a lawyer for the prosecution doesn't necessarily establish a prima facie case of conflict of interest. At your next appearance you/your counsel could raise the matter with the presiding magistrate/judge for his/her consideration in the interests of justice being seen to be impartial. I worked in various areas of law enforcement in Oz for around 20 years and saw similar situations occur. Not saying that I'm an expert in any way, shape or form. Give it a go - but don't be disappointed if it doesn't gain traction.
If youre new lawyer has any credibility he will ask the judge to recuse the prosecutor from the case due to him representing you in another criminal case and what he learned about you can be prejudicial. If he doesn't seek new council. Good luck to you.

Alphamale500I'm not a lawyer so this question is really out of my league, but I have dealt with the legal system many times, lol! But imo, if this lawyer represented you in a prior case and now he's a lawyer for the prosecutor's office, then I think that has to be a conflict of interest. It sounds like a no brainer, but these lawyers can really be slippery so who knows.
I'm sure that your lawyer who's handling your case can answer this for you.

If it’s a conflict they’ll prolly just take him off the case. I wouldn’t get your hopes up for any mistrial or magic problem go-away law because of it.
