+ 3 Ways to protect yourself when traveling on the road with gear.

ad

In no way shape or form am I giving you legal advise or what to do when in trouble. I just want you to be aware of your rights and options in a situation you might find yourself in. The next time you are riding dirty and get pulled over you might want to remember these tips. Keep the gear in the trunk and remember to keep your cool. Try to stay as calm as possible and remember to be very polite to the officer. When the pig approaches the vehicle keep your hands on the steering wheel, so he doesn't think you are reaching for a weapon and giving him a reason to unload 2 full mags into your corpse. If asked while pulled over by the popo, if they can search your vehicle say "I know you are just doing your job officer, but I don't consent to searches." If they ask you "Why, do you have something to hide?" you should respond with "I don't want my property tossed around, damaged, and rearranged." or don't say anything at all. The 5th Amendment in the US protects its citizens from incriminating themselves. If asked to step out of the vehicle, take your key out of the ignition and shut your locked car door directly after you step out. These are ways you can protect yourself in the police state of the US. Also the police still need a warrant to search your trunk, the US Supreme Court ruled in the 2009 Arizona v. Gant case, that the only time a warrant isn't needed for your automobile is in your immediate area of your vehicle, to prevent a suspect from grabbing a weapon or destroying evidence. So if you are out of the vehicle you cannot reach anything in it, so your vehicle shouldn't be searched without a warrant. The Arizona v. Gant case ruling reversed a 30 year period that allowed the cops warrantless searches of your vehicles when pulled over from driving. Know your rights, knowledge is power and nobody is going to go out of their way to give you more power, especially the government. They like keeping you stupid, that way you are easier to control and can be manipulated to do what they want.

The legal definition of DRIVING is:One employed in conducting a coach, carriage, wagon, or other vehicle, with horses, mules, or other animals, or a bicycle, tricycle, or motor car, though not a street railroad car. See Davis v. Petrinovich, 112 Ala. 654, 21 South. 344, 36 L. R. A.615; Gen. St. Conn. 1902,
Law Dictionary: http://thelawdictionary.org/driver/#ixzz2sh9Dqnjy

The key word is EMPLOYED which means you are getting paid for doing that task.

The legal definition of MOTOR VEHICLE means every description or other contrivance propelled or drawn by mechanical power and used for commercial purposes on the highways in the transportation of passengers, or passengers and property.
"Used for commercial purposes" means the carriage of persons or property for any fare, fee, rate, charge or other considerations, or directly or indirectly in connection with any business, or other undertaking intended for profit. Clearly, an automobile is private property in use for private purposes, while a motor vehicle is a machine which may be used upon the highways for trade, commerce, or hire.

I don't recommend using this tactic unless you are properly educated in this subject and prepared to go all the way. This could be an option for you if you are backed in a corner and are facing a lot of fines and/or jail time. Prepare for the worst, be ready to get arrested, have your automobile impounded, and dragged all the way though the legal system. Which could mean appeals are needed to win your case, since many local judges believe in government laws over human rights. The police are trained to violate your god given rights and then you are forced to deal with it in court. This is a great video if you are interested in learning more about this topic:

Those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety.
-Benjamin Franklin

None can love freedom heartily, but good men - the rest love not freedom, but licence.
-John Milton

Man was born free and everywhere he is in shackles.

When the people fear the government there is tyranny, when the government fears the people there is liberty.

Great advice, even though my gear never leaves my house this was an interesting read.

little off topic but I'm sure you'll appreciate this Chemdog, you took me back in time when you said that the court appointed atty's are trained to push and work plea bargains. nothing could be closer to the truth. my senior year I had the world in my palm, was set up and ready to go on the delayed entry program for the USMC. my kid sister and I went to an inner Detroit city public school, she was 2yrs my junior and for some time on the radar of one of the citys toughest gang leader kid brother, now after many attempts of telling this punk to pound sand that she wasn't interested, I guess he wasn't used to having anyone tell him no, after he had groped her and she smacked him right there in the middle of the hall between classes, he proceeded to hit her repeatedly, with closed fists. well after one of my classmates who witnessed this came and found me, I confronted him and the other two deadbeats he had with him. this SOB pulled a lock blade from his pocket and told his two buds to grab me. the first one who reached my space was met by me grabbing him and pushing his face into the metal locker, as the instigator came at me with knife drawn I was fortunate enough to have spun around grabbing him and flipping him over my shoulder and the second floor railing we were on and sending him 10ft to the first floor where he sustained multiple fractures. in the midst of this I was cut by that knife that required 8 stitches to my elbow. and for that third kid well he tucked tail and ran not before picking up his buddy's knife. after being arrested and both parties willing to drop charges, the state decided to pick up the case and charge me with 2 cases of felony assault with intent, and appointed me a public defender who took this case almost all the way to me copping to a plea of lesser charges that still would have branded me a felon for life with no chance of ever serving my country. I was fortunate that my father contacted his brother in law my (wealthy) uncle who flew up from Florida and hired a prominent defense attorney on my behalf, and the next time I stepped into the courtroom was to sign papers that the state was dropping the case provided I did six months probation, completed my senior year at another school and meet my enlistment date. I have taken an oath to defend the constitution and protect this country from all enemies foreign and domestic, in which I will happily sacrifice my life in doing so, however our legal and justice system is something less to be desired.

I'm glad you had a chance to serve, it is sad that public servants don't put more effort into making our country a better place. I swear they are trained to fill quotas, whether someone did something bad or not instead of investing that money into properly educating the youth. It is sad that the US is the wealthiest country in the world with an abundance of resources but we only rank 17 in the Global Education Rankings. As veterans people listen to us, so we need to help make changes for the better. I didn't serve this country so it can turn into a police state, especially after the Patriot Act went into effect, allowing all types of human rights violations against our fellow Americans. I think every person has an obligation to make the planet a better place and it starts with getting the proper representatives in office. Americans might not agree on all of the issues, but we need to do the things that benefit the people, like getting rid of the Federal Reserve and preserving our inherent rights. Facts about 9-11 keep coming out, but yet we still elect people from the same groups that allowed it to happen.

You could also put your gear in a post office box addressed to some one else in your trunk. Closed and sealed they can open mail or parcels they would violate federal law and can end in jail them self. Just my two cents.

You could also take a cab and place it on the floor. It's not in your possession and the cab driver will get charged. All you have to say I don't know nottin I'm just taking a cab from point A-b

I like the fake mail camouflage, that is a great idea.

Thank my boy jean for that one. He is a post man. He told me about that one

Awesome; but you forgot a VERY big thing they do here in the states; if you do not consent to a search they can get a sniffing dog and "make" him sniff something. Then your rights are out the window. They do it a lot in CT and Mass and it's a 50/50 chance to get thrown out. So make sure you are recording the stop in case they do it. They also try and trick you to open your vehicle again to get your registration or something else so make sure when you remove yourself from your vehicle you take all paperwork with you.

ChemDawg's picture

They still need a search warrant to dig around in your car after a police dog allegedly makes a hit on your car. Many of these crooked pigs train their police dogs to sit on command, so they can say the dog hit on something in the vehicle. Many cases are thrown out because the dog and his trainers credibility are brought into question. With all of the hits on vehicles without anything bad in them, they don't look reliable.

When I travel I usually smuggle my gear rectally like ED, no homo.(jk) ;P

So glad someone said it

They don't want you challenging them, because if enough people took their unlawful cases to court instead of just paying the fine, they would plug up the legal system and they would be forced to fire unneeded cops. A court appointed lawyer would never agree to use the tactics I mentioned in the later half of what I wrote. They are trained to take plea bargains, whether you did it or not. They don't want to waste their time on someone that cant pay for their services. The fact that the same group that is taking you to trial, that is paying the public defender should be a conflict of interest. If you cant afford a good attorney, you often have to represent yourself.

Thanks man. Will remember this if it happens

Great stuff but when you get to the definition of employed, in this case it means, "make use of", as in, "To get from point A to point B they employed a motor car."

And I wouldn't split hairs on the Motor Car, Motor Vehicle, automobile when I go to the Department Of Motor Vehicles to register my Motor Car.

But to reiterate, very interesting stuff in that first paragragh

ChemDawg's picture

As of late I have been doing some research on the sovereign citizen movement, which is growing as more and more are getting informed. Many say that a drivers license and registration is not needed to commute by an automobile on the road, for personal reasons, the way the Constitutional Law is written, to protect our god given rights. They consider many laws to be unconstitutional because the government is only allowed to make laws to protect commerce, which is why a military is needed to prevent invading forces destroying our economy. The nay sayers of this say if the current driving system was abolished, there would be a lack of funds, from losing out of that money, that would cause the public roads to fall into disrepair. The supporters argue that the tax on gasoline will pay for roads and only half of the money from licenses and registrations actually goes to the state and the other money goes to the politicians secret agendas and bonuses. They also say that the reason your name is in capitol letters on you drivers license is to make you, as an entity, a corporation.

I think that a couple got arrested last year for plotting to kill a police officer. I think they were sov. cit movement.

This father and son took out 2 cops. As I said before law enforcement loves to create negative propaganda on the groups of people that oppose them and they like to justify their violations by spreading lies by labeling all sovereign citizens terrorists with no respect for other humans. It wasn't ok for the sovereign citizens to kill 2 cops, but it was ok for the cops, according to them to kill them. They allowed their emotions to control their actions and they executed the father and son in a crowded public place, putting others lives in danger by spraying rounds at their opponents.

...because the government is only allowed to make laws to protect commerce,...

Don't get me started... Almost everything the Government is doing is unconstitutional.

HllwdBdBoy's picture

I'm well versed in sovereign citizenship and trust me underground is both safer and easier than sovereign

ChemDawg's picture

I agree, the people that go out looking for trouble are just assholes and law enforcement loves to spread lies that all of the sovereign citizens think that way and that they want anarchy.
