DUI

ad

So I just recently got arrested for a DUI. I am super stressed and anxiety is through the roof. It was a complete moron move. I was wondering if anyone on here has had DUI(s) before and can offer any advice or insight on how the process we to and how/what they did during the whole process.

Don’t skimp on the lawyer is #1 and talk to him about getting a provisional license so get can get back and forth to work when you loose your license. 2nd most important thing is while you have your provisional license get those classes done because if you put them off and when your provisional license runs out you will have to find a way there and back with no license. Since they changed laws in most states in 2015-2017 you will have to lose your license for a year if convicted there isn’t much wiggle room anymore however as long as your employed you can get a provisional license to get back and forth to work and the grocery store etc. You will also probably have to complete DUI classes to get your license back after the year is up so get those done while you have your provisional license so when the time comes all you have to do is go to the dmv to get your license back. Laws are a little different in every state in the US but most of them cracked down between 2015-2017 and this is a general guideline as what to expect. Good luck brother

There's something that shocks me a bit ... So you take steroids AND you drink alcohol ?
This is a really risky behavior ...

Got one. Listened to people and paid for a good lawyer so he could stand next to me while my charges were read. Complete waste of money.
In my state anyway the DUI law is cut and dry. 1st one gets this sentence, 2nd time gets this sentence and so on.
End result was 1400 fine 2month license suspended and 13hrs are classes. Paid twice that for attorney to stand there. Coulda went by myself. And I'm not joking.

sorry to hear about the dui. I look back and see how many times i drove buzzed or completely drunk and was so lucky not to be pulled over. So much to the point i would have nightmares of driving drunk.. i can say i havent had even a sip of alcohol in 11 months. Its been hard but i feel sooo much better now. I hope you get everything worked out.

Arrest = paid lawyer.
Get someone local out of that county that specializes in your charges.

Would love some details brother, prior cop here. Did you make any oral or written statements? Did you submit to a breath or blood test? Did you acknowledge your rights?

Yes, you being in a vehicle with access to keys accounts for a DUI.

Hire a lawyer, forget about the cost, it will pay for itself in the long run.

Ok so I do believe I wasn't breathalyzed or blood tested as I apparently verbally admitted to being under the influence of Xanax. So no written statements, no breath test, and no bloods.

So no breath/blood test, no written statements but you did make a verbal statement. Unfortunately most officers have some type of recorder on them either video or audio. If there is no recording, which your lawyer can find out, he may suggest that the officers heard wrong, wink wink and that you never made that statement. Either way your best bet is to hire a lawyer and see if they can make this go away. I want updates for sure.

You have to throw money at it. I’ve only had 1 DUI, and I was a minor. I got that dropped to reckless driving. First day I met with the attorney, I said Ill spend whatever in fines to make this go away. The attorney cost me (my parents) 2k and 3k in fines. The best part of this story is attorney client privilege so dude lied what the whole thing was about so my parents would flip the bill.

It doesn’t come with SR22 and is only like 4-6 points. As far as I know, employers aren’t checking for reckless driving, unless you drive their vehicles.

And no interlock or license suspension. Sure seems a hell of a lot better.

mlr2199's picture

First is a misdemeanor. Probably have to get SR22 insurance, possibly a interlock system. But I would get a lawyer. Good luck brother.

Never submit to anything never blow never do the test and no blood tests

Ozninjaguy's picture

Things are different in every country. In Oz if you refuse a breath test you are immediately arrested for failing to provide a roadside breath test. Then you will be taken to a 'booze bus' and asked to supply a sample - if you again refuse you can and will be taken to a hospital for a blood sample - whether you like it or not. I see the sobriety tests on US cop shows and laugh my arse off....in Oz they also take a saliva swab for drug use as well as an alcohol breath test...refusing either or both is an offence.

Muffins's picture

Always opt for the blood test if you’re required for one or the other, unless you have some drugs in your bloodstream. That drive to the hospital could be the time you need to be get under the legal limit.

No, no one was injured. I was parked in a Carl's Jr parking lot, passed out, and a cop rolled up next to me

Wow. You must of been high as F#(k to be at a Carl’s Jr....

Seriously, get a good lawyer and I hope you learned your lesson (DUI & Carl’s Jr.).
